These Terms & Conditions ("Terms") govern your access to and use of the ENKAI LUXE website, mobile experience and any related services (together, the "Site"), and your purchase of any products through the Site. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Who we are
ENKAI LUXE ("ENKAI", "we", "us", "our") sells hair care and beauty products online. Our registered address is Utumishi Co-operative House, Mamlaka Road, 2nd Floor. You can reach us at sales@enkailuxe.africa or 0703 731 007.
2. Eligibility and accounts
You must be at least 18 years old, or have a parent or guardian's consent, to place an order on the Site. When you create an account, you're responsible for keeping your login details confidential and for all activity that happens under your account. Let us know right away if you suspect any unauthorized use.
3. Products and pricing
- All prices are listed in Kenyan Shillings (KSh) and include applicable taxes unless stated otherwise.
- We take reasonable care to describe and display our products accurately, but colours, packaging and formulations may vary slightly from what's shown on screen.
- We may update prices, descriptions and availability at any time without prior notice, and may limit quantities on any order.
- In the rare case a product is listed at an incorrect price due to a technical or clerical error, we reserve the right to cancel the affected order and refund any amount paid.
4. Orders and payment
Placing an order is an offer to buy the selected products, which we may accept or decline at our discretion - for example, where a product is out of stock, we suspect fraud, or delivery isn't available to your area. Payment is processed at checkout through our supported payment methods, and your order is only confirmed once payment has been successfully received.
5. Shipping and delivery
Delivery timeframes shown at checkout are estimates, not guarantees, and may be affected by your location, courier availability or circumstances outside our control. Risk in the products passes to you once they're delivered to the address you provided. Please make sure your delivery details are accurate - we're not responsible for delays or misdelivery caused by incorrect information.
6. Returns, refunds and cancellations
If something arrives damaged, faulty, or different from what you ordered, contact us within 7 days of delivery at sales@enkailuxe.africa with your order number and photos where relevant, and we'll arrange a replacement, refund or exchange. For hygiene reasons, opened or used hair and beauty products generally cannot be returned unless faulty. Approved refunds are issued to your original payment method within a reasonable time.
7. Intellectual property
All content on the Site — including text, graphics, logos, product photography and the ENKAI name and branding - belongs to ENKAI or our licensors and is protected by intellectual property law. You may not copy, reproduce, or use it commercially without our written permission.
8. Acceptable use
You agree not to misuse the Site - including attempting to gain unauthorized access to our systems, interfering with the Site's operation, scraping content without permission, or using the Site for any unlawful or fraudulent purpose.
9. Limitation of liability
To the fullest extent permitted by law, ENKAI shall not be liable for any indirect, incidental or consequential loss arising from your use of the Site or products purchased through it. Nothing in these Terms limits any liability that cannot legally be excluded, including liability for defective products under applicable consumer protection law.
10. Changes to these Terms
We may update these Terms from time to time to reflect changes in our practices or for legal reasons. The updated version will be posted on this page with a revised "Last updated" date, and continued use of the Site after changes take effect means you accept the revised Terms.
11. Governing law
These Terms are governed by the laws of Kenya, and any disputes arising from them will be subject to the exclusive jurisdiction of the Kenyan courts.
